The bankruptcy process differs depending on whether you are filing for Chapter 7 or Chapter 13. The steps in each process are as follows:

  • Chapter 7 - involves taking a “means test” prior to filing, which establishes the validity of your financial hardship. Generally, if you pass the test, you will be able to successfully file with the court. Once you have done so, you will have a creditors meeting, in which your debt, and the bankruptcy, is discussed with your creditors. Any disputes they have regarding the discharge of your debt will take place at this meeting, and subsequent meetings, if necessary. Upon successful completion of the means test, you will likely see your eligible debt discharged by the court within 75 days.
  • Chapter 13 - does not require a means test to file, but you must be able to establish that you have the income necessary to fund the payment plan you will be entering into. Once you have filed, you will work out this payment plan with the bankruptcy court. Following that, you will have a creditors meeting to discuss the specifics of the plan with your various creditors. If there are no disputes, the meeting concludes, and you will enter into the plan shortly thereafter. The time-frame for completing the payment plan depends on the amount of debt you possess, but typically it takes between 3 and 5 years.
