Is Everyone Going To Know That I Have Filed Bankruptcy?

Question: I think I have to file for bankruptcy because I lost my job and then I started a business which is failing. I used to work as a chiropractor in Sandy Springs and Roswell. But business declined over a few years and I invested in a cigar store. The cigar store was located in Forsyth County and was fun. I enjoy smoking cigars and pipes but that business has not been doing very well.

I put a lot of expenses on credit cards and now I'm paying a huge interest rate and I'm heavily in debt. They are charging me late fees. I have not made a credit card payment in 2 months. I'm getting a lot of calls from the credit card companies. It's like they're harassing me.

My partner in the cigar store has already filed personal bankruptcy and he is now being supported by his grandfather who owns a big tobacco farm and has a house in Johns Creek.

I know that if I file bankruptcy I'll be in a much better position. I really do need a fresh financial start. My partner is a lot less stressed than he was before he filed bankruptcy.

I was curious if everyone will know that I filed bankruptcy? I'm a private person.

Answer: While a bankruptcy filing is a public record, people have to go and look in the right location to find out that you have filed. But that location isn't so easy to access. Someone would need access to the bankruptcy court system, or hire someone who has that access. Try it yourself and see. It's probably a lot more difficult than you thought.
