Wage Garnishment: File Bankruptcy or do Debt Negotiation?

Question: I have to file bankruptcy or negotiate my debts because I'm getting sued by a credit card company and I can't pay them right now. The credit card company and the lawyers won't work with me on a payment plan. I can't make a lump sum payment to them for the entire amount of the debt but I think I can pay over time.

I live in Sandy Springs and I got into debt from a divorce and then I got another job that didn't pay as much as my last position. I'm in commercial real estate and things are getting better but I don't have enough money to pay all my debts for my credit cards, loans, mortgage and car. And I pay child support to my first wife.

I need to know what my options are. I have never filed bankruptcy but I will if I have to. I need to figure out what I can do to stop the lawsuit and make sure I don't get a wage garnishment. I can't afford to get garnished because then I won't be able to pay my monthly bills.

Answer: We have many clients in the same position you are in. It sounds like you have a couple of options that can be utilized to prevent a wage garnishment.

Bankruptcy will stop a garnishment. Filing a chapter 7 or a chapter 13 will prevent a garnishment from moving forward. By law, once a bankruptcy is filed, a garnishment must cease.

Another potential option is debt settlement or debt negotiation. Debt settlement is where our law firm contacts the creditor and seeks to negotiate a settlement to the debt. We do debt settlement for many clients. We try to negotiate the lowest possible payment for you. If the creditor agrees to the proposed terms of settlement, then they will stop the garnishment.
